Terms of Use

1. Acceptance of these Terms

By accessing or using the Services you agree to be bound by these Terms. If you use the Services on behalf of an institution, you confirm that you are authorized to act for it. If you do not agree with these Terms, do not use the Services.

2. The Services

Pontar is a platform that education and migration mediation institutions ("Institutions") use to manage programs, courses, students, faculty, timetables, attendance, assessments, learning content and fees. Each Institution operates as a separate, isolated tenant on the platform.

3. Accounts

Access to the Services is provided through your Institution, typically by invitation. You agree to provide accurate information, keep your sign-in credentials confidential and notify us or your Institution promptly of any unauthorized use of your account. You are responsible for activity that occurs under your account.

4. Institutions and roles

Administrators of your Institution control who can access its tenant and which roles and permissions each member has. Your relationship with your Institution — including enrollment, employment and payment obligations — is governed by your agreement with that Institution, not by these Terms.

5. Acceptable use

When using the Services you agree not to:

• Use the Services for any unlawful purpose or in violation of these Terms.
• Access or attempt to access data of another user or Institution without authorization.
• Interfere with or disrupt the operation or security of the Services.
• Copy, scrape, decompile or reverse engineer any part of the platform.
• Impersonate another person or misrepresent your affiliation.
• Misuse attendance features, for example by sharing QR check-in codes so that someone is marked present when they are not.

6. Your content

You and your Institution retain ownership of the content and records you submit to the Services. You grant us the right to host, store and process that content solely to provide and improve the Services. Institutions are responsible for the accuracy and lawfulness of the records they manage on the platform.

7. Fees

Institutions pay subscription fees for the platform under their agreement with Pontario. Student fee plans, installments and payment records managed inside the platform are administered by the Institution; unless expressly stated otherwise, Pontario is not a party to payments between students and their Institution.

8. Intellectual property

The Services, including the software, design and branding, are owned by Pontario and protected by intellectual property laws. We grant you a limited, non-exclusive, non-transferable right to use the Services in accordance with these Terms.

9. Availability and changes

We may modify the Services, add or remove features, and suspend the Services temporarily for maintenance. We do not guarantee that the Services will be uninterrupted or error-free.

10. Suspension and termination

We may suspend or terminate your access if you violate these Terms or if your use creates risk for the platform or other users. Your Institution may also deactivate your account at any time. Upon termination, provisions that by their nature should survive will survive.

11. Disclaimers

The Services are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose and non-infringement.

12. Limitation of liability

To the maximum extent permitted by law, Pontario will not be liable for indirect, incidental, special or consequential damages, or for loss of data, profits or revenue, arising from your use of the Services.

13. Changes to these Terms

We may update these Terms from time to time. We will post the updated version on this page and, for material changes, notify you through the Services. Continued use of the Services after changes take effect constitutes acceptance of the updated Terms.
